Welcome to Telegenix. By accessing this website, creating an account, or purchasing any service or medication offered through Telegenix, you agree to these Terms of Service. Please read them carefully — they govern the relationship between you, Telegenix Health, Inc. ("Telegenix," "we," "us"), and the licensed physicians and pharmacies that fulfill care through our platform. 1. ELIGIBILITY Telegenix services are available only to U.S. residents who are 36 years of age or older. By using the platform you represent that you meet that age requirement and that you are legally able to enter into a binding agreement. We may refuse service or cancel orders at our discretion if you do not meet these criteria. 2. NATURE OF SERVICE — TELEMEDICINE Telegenix is a telemedicine platform. We connect you with state-licensed physicians who evaluate your intake and bloodwork, prescribe when medically appropriate, and route fulfillment to a partner pharmacy. Telemedicine is not a substitute for in-person emergency care. If you are experiencing a medical emergency, call 911 or go to your nearest emergency room immediately. 3. NO DOCTOR-PATIENT RELATIONSHIP UNTIL APPROVED Submitting an intake quiz or purchasing a kit does not by itself establish a doctor-patient relationship. That relationship begins only when a Telegenix physician reviews your file, approves you for a protocol, and a prescription is issued. Until that moment, no prescription is authorized and no clinical advice has been given. 4. ACCOUNTS AND ACCURATE INFORMATION You agree to provide accurate, complete, and current information at intake, checkout, and during ongoing care. Withholding material medical history — current medications, prior treatments, contraindicated conditions — can compromise your safety and is grounds for immediate termination of service. 5. PAYMENT AND BILLING Subscriptions are billed in advance on a monthly or annual cadence according to the plan you choose. You authorize Telegenix to charge the payment method on file at each renewal. Failed renewals are retried per the schedule disclosed in your account. Refund treatment is governed by the separate Refund Policy. 6. PRESCRIPTION FULFILLMENT Fulfillment requires a valid prescription issued by a Telegenix physician licensed in your state. Some medications cannot be shipped to certain states; we will surface restrictions at checkout and decline orders that violate them. Once a prescription is approved, fulfillment timelines are subject to pharmacy capacity, shipping carrier performance, and any temperature-controlled handling required. 7. PROHIBITED CONDUCT You agree not to misuse the platform, including but not limited to: sharing your account with another person, reselling medications, falsifying medical information, attempting to obtain prescriptions through fraud, or interfering with the integrity of Telegenix's systems. We may suspend or terminate accounts engaged in any of the foregoing. 8. INTELLECTUAL PROPERTY All content on the platform — including educational material, clinical protocols, branding, software, and the look and feel of the site — is owned by Telegenix or licensed to Telegenix and is protected by U.S. and international copyright, trademark, and trade-secret law. 9. DISCLAIMERS To the maximum extent permitted by law, the platform and all services are provided "as is" without warranty of any kind, express or implied. Telegenix does not guarantee a specific clinical outcome. Individual results vary. 10. LIMITATION OF LIABILITY To the maximum extent permitted by law, Telegenix and its officers, employees, contractors, and affiliated physicians will not be liable for indirect, incidental, special, consequential, or punitive damages arising from your use of the platform. Total liability for any claim is limited to the amount you paid Telegenix in the twelve months preceding the claim. 11. INDEMNIFICATION You agree to defend, indemnify, and hold Telegenix harmless from any claim arising out of your breach of these Terms, your violation of applicable law, or your misrepresentation of medical history. 12. DISPUTE RESOLUTION Any dispute arising under these Terms will be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules. You waive the right to a jury trial and to participate in any class or collective proceeding. 13. GOVERNING LAW These Terms are governed by the laws of the State of Florida without regard to its conflict-of-laws principles. 14. CHANGES We may update these Terms from time to time.
